Competition

Piercing - Lovisa Competition

1. Information on how to enter and the Prizes form part of these terms and conditions. These terms and conditions constitute the entire agreement between each entrant and the Promoter. Entry into the competition (Competition) is deemed acceptance of these terms and conditions.

2. The promoter is LOVISA PTY LIMITED (ABN 62 120 675 890) of Level 1/818 Glenferrie Rd, Hawthorn VIC 3122 (the Promoter).

3. The Competition commences at 9.00am AEST on 26 February 2024 and concludes at 11.59pm AEST on 24 March 2024 (Competition Period). The Promoter may extend the Competition Period in its sole discretion, in which case the Promotor will provide notice of the extension via the @lovisajewellery Instagram account.

4. All entries are deemed to be received at the time of receipt by the Promotor NOT at the time of sending by entrants. Late entries are not eligible and will not be considered as valid entries to this Competition.

Eligibility

5. Entry to the Competition is open to all individuals who meet the following criteria (Eligibility Criteria):

(i) entrants must be aged 13 years or older, however any entrant under the age of 18 years of age must only enter the Competition with the consent of a parent or guardian;
(ii) entrants must have a valid Instagram account; and
(iii) entrants must have (or have access to) an email address..

6. Employees and agents of the Promoter and any other person who assists in determining the Winner of Competition and their immediate families are not eligible to enter the Competition.

How To Enter

7. The Competition will be hosted using the Instagram social media platform. To be eligible for entry into the Competition, each entrant must have a valid Instagram account which they can access and log into.

8. Each eligible entrant can submit one (1) valid entry into the Competition by:

(i) ‘following’ @lovisajewellery Instagram account during the Competition Period and at the time the Winner is announced;
(ii) purchasing a piercing at a Lovisa store; and
(iii) posting a video or photo of you showing your Lovisa piercing and the Lovisa Piercing filter on your personal Instagram page, including the hashtag #lovisapiercing and tagging the @lovisajewellery Instagram account in your post.

For the avoidance of doubt, each post that ‘tags’ @lovisajewellery will be considered a separate entry into the Competition) and multiple entries in the Competition will be accepted, provided the above eligibility criteria in clause 8 are satisfied.

9. Entries must not contain references which are obscene, crude or vulgar, and/or which contain phone numbers, personal addresses (physical or email), Website URLs, derogatory characterisations of any ethnic, racial, sexual or religious groups, references to illegal or inappropriate activity, behaviour or conduct, or any other references that could be considered inappropriate, unsuitable or offensive, as determined by the Promoter. The Promoter may delete any entries it deems offensive or inappropriate in its discretion and such entries will be disqualified from the Competition.

The Prize

10. Five winners will be selected by the Promotor at random after the conclusion of the Competition Period (the Winner) and will be announced on the @lovisajewellery Instagram account by no later than 6.00pm AEST on 29 March 2024.

11. Each Winner will receive a $500 USD Lovisa digital gift card (the Prize). There are only five Prizes and five Winners for this Competition.

12. If (for any reason) it is not possible to supply the Prize as advertised, the Promoter may supply a substitute prize of at least equivalent value, in accordance with all applicable laws.

The Winners

13. The Winners will be notified via Instagram direct message (“DMs”) according to the account username associated the Competition Post. At the time of notification, the Winners will be asked to provide a valid E-Mail address to which the Promotor can send the Prize.

14. The Promoter will not be responsible for any costs associated with winning the Prize or obtaining the Prize itself unless specifically stated in these terms and conditions.

15. The Winners are only entitled to the Prize as outlined above and is not entitled to any additional prizing. No compensation is payable to the Winners if the Winners cannot receive any aspect of the Prize for any reason.

16. Once the Promotor makes contact with the Winners and confirms their details, the Winners will be announced and their first name, Instagram account username and state/territory of residence may be published via the @lovisajewellery Instagram account and the Lovisa website. Please refer to clause 27 of these terms and conditions regarding the handling of personal information.

Forfeiture of Prize or Disqualification

17. The Winners of the Competition will be taken to have forfeited the Prize in any of the following circumstances:

(i) if the Winners cannot be contacted for any reason within forty-eight (48) hours of the Promotor’s first notification attempt (such as if the Winner’s Instagram account has been deactivated, if the Promotor’s notification message is returned as undeliverable, or the Winners fails to response to the Promotor’s direct message within forty-eight (48) hours);
(ii) the Winners rejects the Prize; or
(iii) the Winners fails to meet the Eligibility Criteria.

18. In addition, the Promoter in its absolute discretion reserves the right to verify the validity of all entries and to disqualify entrants (including the Winners) if the Promotor (acting reasonably and in good faith) believes that the entrant has, or has attempted to, act in bad faith in relation to the conduct of the Competition or tamper with the entry process, including submission of an entry not in accordance with these terms and conditions.

19. In the event the Winners forfeits the Prize, or the Winners are disqualified from the Competition, the Promotor may either:

(i) select alternative winners at random from all remaining eligible entries, in which case the new winner will be awarded the same Prize without any modification; or
(ii) publish, via an Instagram post on the @lovisajewellery Instagram account, that there is no valid Prize winner or that the winners were not able to be found (as applicable).

20. Upon Prize forfeiture or disqualification, no compensation will be given to the originally selected Winners or to any other entrant.

Liability

21. Under the Australian Consumer Law and other statutes and regulations, there are some warranties and conditions that cannot be excluded, restricted or modified or can only be excluded, restricted or modified to a limited extent. The Promoter excludes (or limits) all guarantees, warranties, conditions or other terms and conditions to the extent allowable by these laws.

22. The Promoter accepts no liability or responsibility of any kind for any defect with the Prize nor for any loss or damage whatsoever suffered (including indirect or consequential loss) which is suffered or sustained in connection with the Competition or a Prize in any way to the fullest extent allowable by law.

23. All additional costs not expressly stated in these terms and conditions but incurred in acceptance and use of the Prize is the responsibility of the Winners and will NOT be the responsibility of the Promoter. The Winners will be responsible for paying for those costs not expressly set out in these terms and conditions and which may include additional taxes, postage or other ancillary costs which are the sole expense and responsibility of the Winners.

24. If the Competition or Prize is not capable of running as planned due to any reason (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures, communicable disease (including Covid-19) or related government actions or restrictions, or any other causes), the Promoter reserves the right without liability to the entrants to cancel, modify, terminate or suspend the Competition, subject to applicable law.

25. The Promoter is not responsible for any misdirected, late or incomprehensible entries in the Competition, or for any problems or technical malfunctions of any telephone network, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading or uploading any materials in this Competition.

Privacy

26. The Promotor may collect personal information about entrants in order to enable participation in this Competition, however no further use of this information will be made without the applicable entrant’s prior consent. The Promotor may be required to disclose personal information collected as part of this Competition to a relevant government authority or as otherwise required by law. General terms

27. The Promoter’s decision in relation to any aspect of the Competition is final and binding on every person who enters, and no correspondence will be entered into.

28. The Promoter is not responsible for any tax implications that may arise from winning a Prize. Entrants should seek independent financial advice about such matters.

29. By participating in the Competition using the social media platform Instagram, you agree to a complete release of Instagram and Meta Platforms, Inc. by each entrant or participant. The Promotor’s Competition is not sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc., and unless expressly stated otherwise, the Promotor has no partnership with Instagram or Meta Platforms, Inc.

30. The Promotor will keep all records relating to the conduct of this Competition, including all records relating to the selected Winner or Winners (if there is more than one Winner selected in accordance with these terms and conditions) for as long as necessary in order to comply with applicable laws and regulations.

31. These terms and conditions shall be governed by the laws of Victoria, Australia.

Shipping & Delivery 

Lovisa offers an express delivery option. The advised delivery time is from the date the order has shipped, not necessarily the date the order was placed. All orders are usually shipped within 2 business days.

Lovisa Gift Cards are to be treated like cash. Damaged, lost or stolen cards will not be replaced, refunded or redeemed. It is not redeemable for cash, credit or retailer accounts. Lovisa Gift Cards must be redeemed before the expiry date. The gift card cannot be reloaded. Unused balance on expiry of this card will not be refunded or credited.
